This page has two purposes. First, it is the plain-English notice for workers who are asked to scan a QR code at a construction site gate. Second, it provides guidance for builders on their obligations when deploying TrustPoint gate inductions on site.

Your privacy at this site gate

You are about to complete a site induction using TrustPoint. Before you enter your mobile number, here is what you need to know.

What we collect

Your mobile phone number, the date and time you entered, and your compliance status at the time of entry.

Why we collect it

To verify your identity using a one-time SMS code, check your compliance status, and create a site induction record that your employer’s builder uses for health and safety record-keeping.

Who sees it

The builder or site manager responsible for this site. Your information is not shared with other builders or made publicly available.

How long it’s kept

Your induction record is kept for up to seven years. This is standard practice for health and safety records under the Health and Safety at Work Act 2015, in case the record is ever needed for a WorkSafe investigation.

Your rights

Under the New Zealand Privacy Act 2020, you can ask to see or correct the information held about you. Contact the site manager or email operations@trustpoint.nz.

For builders: your obligations at the gate

When you deploy a TrustPoint QR code at a site entrance, you are collecting personal information from workers under the Health and Safety at Work Act 2015 and the Privacy Act 2020. As the person conducting a business or undertaking (PCBU), you are responsible for ensuring workers are informed of this collection before they submit their information.

Display requirement

You must display the Gate Privacy Notice alongside every TrustPoint QR code. The notice must be legible at the point of scan. TrustPoint provides two ways to meet this requirement:

Built into the induction screen: The TrustPoint gate induction page (the page workers see after scanning) displays a summary privacy notice before the phone number field. Workers must scroll past this notice before they can proceed.
Physical signage: For physical QR posters, print and display the gate privacy notice text alongside the QR code. The text of this notice may be printed freely for this purpose.

Your duty under HSWA 2015 is not discharged by TrustPoint. The gate induction record TrustPoint creates is a compliance record, not a substitute for your legal obligation to ensure the health and safety of all workers on your site. Worker access and deletion requests

If a worker contacts you directly requesting access to or deletion of their gate induction records, you may direct them to operations@trustpoint.nz. TrustPoint will respond to access and deletion requests within 20 working days as required by the Privacy Act 2020.

Note that certain induction records may be retained beyond a deletion request where retention is required for health and safety record-keeping under HSWA 2015.
